El próximo 17 de mayo el catálogo de especies protegidas de Canarias cumplirá un año desde su aprobación por parte del Parlamento de Canarias. La polémica ley autonómica pasó el trámite con los votos a favor de Coalición Canaria y Partido Popular y la oposición del Partido Socialista. El PSC-PSOE se unió entonces a un malestar patente entre la práctica totalidad de la comunidad científica, incluyendo a las dos universidades del Archipiélago, y que se trasladó a la calle en forma de protestas e iniciativas ciudadanas contra una norma que reduce la protección de la rica biodiversidad canaria.
Detrás de la nueva ley, apuntan sus críticos, está el interés urbanístico por macroproyectos como el del puerto industrial de Granadilla, en Tenerife, pendiente de la descatalogación de la seba, vegetación marina que forma praderas de gran valor ambiental conocidas como «sebadales», como «especie en peligro de extinción».
Hace ahora un año, al subir al estrado del Parlamento, la diputada socialista Guacimara Medina se mostró contundente al señalar que «el bienestar de Canarias se encuentra en peligro» y habló de «una matanza acelerada en beneficio exclusivo de la generación presente». El Ministerio español de Medio Ambiente se precipitó también a anunciar que el nuevo catálogo canario sería recurrido ante los tribunales de justicia, tal y como señalaron todas las informaciones publicadas. Sin embargo, un año después, el discurso a favor de la biodiversidad no ha tenido efectos prácticos, ya que el Gobierno central no ha presentado recurso alguno contra una norma que rebaja el nivel de protección de 290 especies y deja sin proteger a 89. La decisión de no recurrir ante el Tribunal Constitucional se llevo a cabo por parte del gobierno de España a pesar de que el ejecutivo socialista contaba con un informe de la Dirección General de Medio Natural y Política Forestal, dependiente del Ministerio de Medio Ambiente, que denunciaba las «disconformidades» del Catálogo de Especies Protegidas de Canarias en relación a la Ley Estatal y que se ha conocido recientemente. A pesar de la contundencia del criterio expresado en ese documento por José Jiménez García-Herrera, director general del departamento, el Ejecutivo del PSOE descartó la posibilidad de recurrir la norma canaria al Tribunal Constitucional, «casualmente poco después de que CC decidiera apoyar los Presupuestos Generales del Estado«, según denuncian los ecologistas.
Que los sebadales no paren al puerto
El catálogo de especies protegidas puede verse como un episodio más de la larga batalla librada por los ejecutivos canario y español para construir el puerto de Granadilla, al sur de Tenerife, a pesar de los inconvenientes legales que a priori pudiese conllevar el proyecto.
En 2009 el Tribunal Superior de Justicia de Canarias suspendió la decisión del Gobierno autónomo de desproteger parte de los sebadales (Cymodocea nodosa) del sur de Tenerife. La medida supuso la paralización de las obras de construcción del puerto de Granadilla, por el «daño irreversible al ecosistema marino» que el proyecto podría provocar. A partir de la aprobación, en mayo de 2010, del nuevo Catálogo de Especies protegidas de Canarias, los sebadales perdían su protección y el proyecto del Puerto de Granadilla encontraba un obstáculo menos en su tramitación.
También en esta ocasión las expectativas ecologistas se pusieron en lo que el Ministerio español de Medio Ambiente hiciera en el Catálogo Estatal de Especies Amenazadas. Dicho organismo recibió, según Ben-Magec, unas 2.000 alegaciones durante la tramitación de la ley para que la seba fuese declarada especie a proteger. Sin embargo, a principios de febrero de este año el Consejo de Ministros aprobaba el listado estatal de especies sin incluir a los sebadales de Canarias.
